ORDER

The petitioner, who is the resident of Paralipudhur village, Dindigul District, has approached this Court seeking a writ of Mandamus directing the official respondents not to cut any trees in order 2/6

to lay tar road in S.No.234 situated at Parali Pudhur Village, Natham Taluk, Dindigul District.

2.The case of the petitioner is that the eighth respondent has purchased 22 acres of land in Paralipudhur village. In order to develop his land, he is attempting to lay tar road with the help of the Government Officials. The Government Officials have also yielded to that and they are also intending to destroy the trees and attempting to lay tar road. In this process, they are attempting to cut the trees, which are all grown up in the petitioner's 2C patta land. The petitioner is also having grown up trees in the above said survey number.

3.The learned Special Government Pleader appearing for the official respondents submits that the land in S.No.234 is classified as 'vandipathai'. The respondents are not having any intention to cut the trees and they are only restoring the vandipathai, that too, pursuant to the orders of this Court in WP.(MD)No.13758 of 2025 dated 29.04.2025. The said writ petition has been filed by the eighth respondent herein that 3/6

the persons, who are having land near S.No.234, are not in a position to access this cart track, in view of the 2C patta, which has been erroneously granted in favour of few individuals. This Court by its order dated 29.04.2025, has directed the respondents to consider the representation of the eighth respondent dated 30.08.2024 and to take a decision within a stipulated time. Accordingly, the District Collector has conducted the enquiry and has passed the order dated 27.11.2025 directing the Revenue Officials to restore the cart track by cancelling the 2C patta, if any. The learned Special Government Pleader further submits that they are not inclined to destroy the existing trees and they are only facilitating the farmers to take their goods through the cart track by removing the branches, leading towards the cart track.

4.In view of the above submission of the learned Special Government Pleader, this Court is not inclined to entertain this petition. Accordingly, this writ petition is dismissed. No costs. 08.12.2025 gns 4/6
