PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to proceed the Passport Application in file No.MD01C5022042722, dated 05.04.2022 and to issue the new Passport to the petitioner.

ORDER
The present writ petition has been filed seeking a mandamus as against the first respondent to issue fresh passport based upon his application dated 05.04.2022.
2. The learned Government Advocate(crl.side) appearing for the second respondent submits that the petitioner has been implicated in a criminal case in Cr.No.226 of 2019 on the file of the second respondent herein. A charge sheet has been filed in C.C.No.910 of 2025 on 08.01.2024 on the file of the learned Judicial Magistrate No.I, Ramanathapuram. So far, the trial has not yet commenced.
3. The learned Central Government Standing Counsel appearing for the first respondent submits that an application filed by the petitioner dated 05.10.2025 has been closed and a fresh application has been presented by the petitioner on 28.11.2025.
4. In view of the above said facts, the petitioner is directed to approach the trial Court concerned seeking the permission of the Court to go abroad. In 2/4
case, any such application is filed, the learned Judicial Magistrate concerned is directed to dispose of the same within a period of four weeks. Based upon the order passed by the learned Judicial Magistrate concerned, the first respondent is directed to proceed in accordance with law on the basis of the application of the writ petitioner dated 28.11.2025.
5. With the above said observations, this writ petition stands disposed of. No costs.
