ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the 1/4

offences punishable under Section 229A of IPC, in Crime No. 142 of 2023 on the file of the respondent police, seeks anticipatory bail. After filing charge sheet the same was taken on the file of the learned District Munsif cum Judicial Magistrate, Shenkottai,

2. The learned counsel for the petitioner submitted that since the petitioner was absent for one hearing, non bailable warrant was issued on 19.12.2017 and the same is pending. Hence, the present petition.

3.The learned Government Advocate(Crl. Side) submitted that it is a case of jumped out bail and already Non Bailable Warrant was issued against the petitioner by the trial Court. However, he opposed for grant of anticipatory bail to the petitioner.

4. Considering the same, the petitioner is directed to surrender before the trial Court and submit an application to recall the non bailable 2/4

warrant. On such filing, the learned trial Judge shall consider the said application on the same day itself.

5. With the above direction, this Criminal Original Petition is disposed of.
