ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 2(2), 2(11), 2(18), 2(23), 2(31), 39, 44, 50 and 51 in Crime No.2 of 2024, on the file of the respondent Forest Range Officers, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused were found in illegal possession of 2.385 kgs two Tusks. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 2/5

4. It is informed that the petitioner was already granted anticipatory bail by the trial Court. But, the petitioner has violated the conditions and has not surrendered the vehicle. The petitioner had filed the present anticipatory bail petition before this Court. Earlier, the petitioner took a plea that the petitioner is only the driver of the vehicle and one Pechimuthu is the owner of the vehicle. Hence, this Court directed the prosecution to verify the same and submit the resport before this Court. 5.Today, when the matter is taken up for hearing, the learned Government Advocate (Crl. Side) submitted that when enquired the said Pechimuthu, he has stated that the petitioner was entrusted with the vehicle and he attempted to sell the vehicle. 6.Recording the submission of the learned Government Advocate (Crl. Side) and the report submitted by the respondent/Forest Ranging Officers, this Court is not inclined to grant anticipatory bail 3/5

to the petitioner.

7.Accordingly, this Criminal Original Petition stands dismissed.
