O R D E R

This Writ Petition is filed seeking a direction to the respondents 1 and 2 to consider the petitioner's representation dated 04.09.2025 and to provide alternative site and till then not to evict him from the petitioner's residential house at Karikali Village, Kujiliyambarai Circle, Vedasandur Taluk, Dindigul District, without due process of law.

2. Heard the learned counsel appearing for the petitioner and Mr.K.Balasubramani, learned Special Government Pleader, who takes notice on behalf of the respondents 1 and 2. Since no adverse order is going to be passed against the third respondent, notice to him is dispensed with.

3. By consent, this writ petition is taken up for final hearing at the admission stage itself.

4. It is the case of the petitioner that the third respondent company has acquired the lands in S.Nos.189/1, 187/2, 186, 185, and 177/5 for the purpose of establishing a wind power generation. There are residential houses and agricultural lands in S.No.176/1 situated approximately 50 meters from the proposed wind farm site. The proposed wind farm is being constructed in close proximity to the said residential area, thereby causing noise disturbance to the residents. In this regard, the petitioner has submitted a representation to the respondents 1 and 2 seeking necessary action. However, the said representation has not been considered so far. Hence, the petitioner has approached this Court.

5. The learned Special Government Pleader appearing for the respondents 1 and 2, on instructions, would submit that the representation of the petitioner dated 04.09.2025 would be considered in accordance with law.

6. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the first respondent to consider and pass orders on the representation of the petitioner dated 04.09.2025 on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
