O R D E R
This Criminal Original Petition is filed to set aside the order passed by the learned Judicial Magistrate No.I, Tiruchirappalli, dated 06.10.2025 made in Cr.M.P.No.31222 of 2024.

The learned counsel for the petitioner submitted that with respect to Crime No.38 of 2018 on the file of the respondent police, the accused Sandhanam had filed Crl.O.P.(MD) No.19108 of 2018 seeking anticipatory bail, in which this Court, by an order dated 08/02/2019, had allowed the said application on a condition that the accused should deposit an amount of Rs.12,00,000/- before the learned Trial Court. However, without complying with the said order, the accused, after a period of five years, filed an application for bail in Crl.O.P.(MD) No. 13288 of 2024, since he was arrested. This Court, by an order dated 13/08/2024 modified the earlier condition and directed the petitioner to deposit an amount of Rs.3,00,000/-. The said order was duly complied and the accused had deposited the said amount before the learned Trial Page No. 2 of 5
Court for being enlarged on bail. Meanwhile, the petitioner had filed an application, seeking the learned Trial Court to hand over the said amount to him, which was duly rejected by the learned Trial Court by the impugned order dated 06/10/2025. Hence, this petition.

The learned Additional Public Prosecutor, Mr.S.Ravi, submitted that the Trial Court has rightly rejected the claim of the petitioner on the ground that this Court has directed the accused only to deposit the same and there is no specific direction to permit the de facto complainant to receive the same. However, the learned Trial Court may be directed to deposit the said amount in an interest bearing deposit in any one of the nationalised banks in the said crime number forthwith.
4. I have heard both sides and perused the records.
5. Considering the submissions made on either side, the Trial Court has rightly rejected the petitioner's claim and I do not find any merits in this petition. Accordingly, this Criminal Original Petition is dismissed. Further, the Trial Court is directed to deposit the said amount in an Page No. 3 of 5
