ORDER

The petitioner who is working as a Junior Engineer in Thanjavur Municipal Corporation was arrayed as A3 in Crime No.8 of 2025 on the file of the respondent Police.

2. The learned counsel appearing for the petitioner claims that the petitioner is not having any role in the commission of offence and hence, this petition to quash the FIR.

The learned Additional Public Prosecutor appearing for the respondent Police submits that this petitioner is the Field Level Officer and the Competent Authority, who is responsible for taking measurements in respect of the tender works. The private agency which has taken the tender, has created bogus bills without clearing the wastages and has also appropriated a sum of Rs.9,56,82,048/-. He relied upon the Judgment in W.M.P.Crl(MD)No.501 of 2025 in W.P.(MD)No.4631 of 2025 and submits that this Court vide order dated 27.11.2025 has issued a direction to conclude the investigation in Crime No.8 of 2025 on the file of the respondent Police within a stipulated period and they are having time till August 2026 to conclude the investigation. He states that the investigation is under progress.

4. This Court considered the rival submissions and perused the materials placed before this Court.

5. The petitioner claims innocence and has raised certain points in support of his case that he is not involved in the commission of offence. The 2/4

grounds raised by this petitioner are also to be appreciated by the investigation agency during the course of investigation. In the event, if the petitioner has not committed any offence, the respondent Police is directed to delete his name from the case.

6. With the hope that the investigation agency would conduct the investigation in a fair and proper manner, this Criminal Original Petition is closed, with a liberty to the petitioner to challenge the final report, if any filed against this petitioner. As stated above, the investigation agency has to conduct fair investigation by considering the grounds raised by this petitioner in this petition during the course of investigation. Consequently, connected Miscellaneous Petition is closed.
