PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records of the impugned clarification letter in SCN/1050631328/25 dated 07.10.2025 issued by the first respondent in File No.MD2075645286725 and quash the same as illegal and consequently direct the first respondent to renew/re-issue the petitioners passport bearing No.P5546598 by considering petitioner's re-issue 1/4

application No.251061424788 dated 16.09.2025 within a time frame as fixed by this Court.

ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent herein wherein the petitioner has been called upon to provide explanation with regard to the adverse report submitted by the police.

2. The learned Government Advocate(crl.side) appearing for the second respondent submits that the petitioner has been chargesheeted in a criminal case in S.T.C.No.351 of 2020 on the file of the learned Judicial Magistrate, Eraniel. The order impugned in the writ petition is hereby set aside.

3. The petitioner is directed to approach the trial Court concerned seeking the permission of the Court to go abroad. In case, any such application is filed, the learned Judicial Magistrate concerned, is directed to dispose of the same 2/4

within a period of four weeks. Based upon the order to be passed by the learned Judicial Magistrate, the first respondent is directed to proceed in accordance with law.
