ORDER
(Order of the Court was made by Dr.G.JAYACHANDRAN, J.) Public Interest Litigation is filed seeking mandamus to direct the respondent 2 and 5 to remove the nuisance caused by the drainage water sewage Well situated in Kandhasamy Street, Nehru Nagar, 70th Ward, Zone -4, Madurai - 625016.
2. According to the learned counsel for the petitioner, due to illmaintenance of the drainage water sewage Well, there is leakage in the pipeline and also there was fatal accident two years ago due to the poisonous gas emanated from the sewage Well.
3. The 5th respondent representing the Commissioner, Madurai Corporation, filed a status report, wherein, it is stated that it is a lifting station of sewage water, which is functioning from the year 2020. The leakage stated in Page No.2 of 5
the writ petition has been attended by the Corporation Staff and it is fully arrested. Whereas the lifting station of sewage water is concerned, once the underground drainage project in Madurai gets completed, the lifting station will be automatically converted into manhole of sewer line.
4. In the status report, it is further stated that underground drainage project in Madurai Corporation will be completed on or before 31.12.2027. An undertaking has been given in the status report at Paragraph No.5, which reads as follows:
"5.I humbly submit that the said lifting station is now functioning after carried out the necessary repair works. It is also functioning efficiently with a 15-HP Motor, without causing any disturbance to the public health and we ensure that the said lifting station was maintained proper sanitation. Further, it is submitted that there was no health hazard was happened during and after the repair works."
