Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order of rejection dated 13.11.2025 displayed in the website of revenue E-Savai portal and quash the same as illegal, unconstitutional and arbitrary and consequently direct the 1st and 2nd respondents to issue legal heir certificate to the petitioner and the respondents No.4 to 7 who are the Agnates of the deceased Rathinam expired on 22.12.1987.

ORDER

The present writ petition has been filed seeking to quash the order passed by the 3rd respondent herein on 13.11.2025, wherein the request made by the petitioner for issuance of the legal heir certificate for the death of one Rathinam has been rejected.

2. Mr.B.Saravanan, learned Additional Government Pleader takes notice on behalf of the respondents 1 to 3.

3. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself. Since no adverse orders are to be passed against the respondents 4 to 7, notice to the respondents 4 to 7 is dispense with.

4. According to the learned counsel appearing for the writ petitioner, Rathinam has passed away as a bachelor. His parents are not alive. The legal heirship request has been made by the cousin brother of the deceased Rathinam. The request has been rejected primarily on the ground that the request has emanated from class II legal heirs.

In support of his contentions, the learned counsel appearing for the petitioner has relied upon G.O.(Ms).No.478, Revenue and Disaster Management Department dated 29.09.2022, which has been amended in G.O.(Ms).No.110 Revenue and Disaster Management, Revenue Administration Wing, RA-3(2), wherein provisions has been made for issuance of Legal Heir Certificate for clause II legal heirs also. 3/6

6. Therefore, order impugned in the writ petition dated 13.11.2025 is set aside and the matter is remitted back to the file of the 3rd respondent herein. The 3rd respondent is directed to conduct an enquiry to find out the Class II legal heirs of the deceased Rathinam and thereafter, issue the Legal Heir Certificate in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

7. The writ petition stands disposed of with the above observations. No costs. Consequently, connected miscellaneous petition is closed. 09.12.2025 NCC :yes/No Index :yes/No Internet:yes/No rgm 4/6
