ORDER

This Criminal Original Petition has been filed to direct the learned Additional District and Sessions (PCR) Court, Sivagangai, to accept the petitioner's surrender and to consider his bail application in Crime No.343 of 2025 on the file of the second respondent police to be filed by the petitioner on the same day on merits.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

The case of the prosecution is that when the defacto complainant was standing in the bus stop, the accused persons, who were in an intoxication condition, threw the liquor bottle over the defacto complainant, for which, the defacto complainant raised his handstick towards the petitioner and other accused persons, due to which, the petitioner and other accused alleged to have gone the defacto complainant's house, attacked him using aruval, abused him and his daughter using his caste name and threatened them. 2/5

Based on these allegations, an FIR has been registered against the petitioner and other accused person.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby directs the learned Additional District and Sessions (PCR) Court, Sivagangai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.343 of 2025 on the file of the 2nd respondent police.

6. Accordingly, this Criminal Original Petition is disposed of. 10.12.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No Rmk Note: Issue order copy on 11.12.2025.
