This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to issue patta in favour of the petitioner in respect of S.F.No.265/16, situated at Naanjur Village, Kulathur Taluk, Pudukkottai District, in the light of the judgment and decree passed in O.S.No.399 of 2022 dated 12.06.2023 on the file of the Sub Court, Keeranur, within a time frame to be specified by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that the petitioner purchased the land in S.F.No.265/16, which is adjacent to the petitioner's other land, from the sons of the petitioner's brother, and is in possession and enjoyment of the property. Since there was obstruction and disturbance over the subject property, the petitioner filed O.S.No.399 of 2022 on the file of the Sub Court, Keeranur, against the sons of the petitioner's brother and a third party, which was decreed in favour of the petitioner. Thereafter, the petitioner sent representations dated 08.09.2023, 13.10.2023, 15.11.2023, and 24.12.2024 for mutation of the patta in light of the decree. Although Page No. 2 of 5
the Revenue Divisional Officer, Illupur, sent proceedings dated 21.05.2025 in O.Mu.232918/2024 to the second respondent/Tahsildar for necessary action, no effective step has been taken to issue the patta in the name of the petitioner. Therefore, he prays for a direction to the respondents to issue the patta in his favour.
4. The learned Special Government Pleader for the respondents undertakes to consider the petitioner's request and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.
