O R D E R

This Writ Petition is filed challenging the impugned Refusal Check Slip in Refusal Number RFL/Kalakad/34/2025 dated 03.11.2025 issued by the 1st respondent and seeking for a consequential direction directing the 1st respondent to register the sale deed dated 29.10.2025 in respect of survey No.571/B4 to the extent of 21 cents situated at Seevalaperi Village, Kalakad Sub Registration Circle, Cheranmahadevi Registration District, Tirunelveli District within a stipulated period as framed by this Court.

2. Mr.M.Lingadurai, learned Special Government Pleader takes notice for respondent No.1. Since no adverse order is going to be passed against the 2nd respondent, notice to her is dispensed with. By consent, this Writ Petition is taken up for final disposal.

3. It is the grievance of the petitioner that when the petitioner presented a sale deed for registration, the same was refused to be registered on the ground that there was an objection petition by the 2nd respondent. Challenging the same, the petitioner has filed this Writ Petition.

4. The learned Special Government Pleader appearing for the respondents would submit that the if the petitioner represent the sale deed, the same will be registered.

5. Considering the facts and circumstances of the case, this Court is of the view that merely on the basis of a protest petition, the document cannot be refused to be registered. Therefore, the impugned order is liable to be quashed.

6. Accordingly, this Writ Petition is allowed and the impugned refusal check slip issued by the first respondent is set aside. The petitioner is directed to represent the sale deed. Upon representation, the first respondent is directed to conduct enquiry, after issuing notice to the petitioner and the 2nd respondent and thereafter, take appropriate take decision with regard to the registration of the petitioner's sale deed.
