2. It is brought to the notice of this Court that some typographical error has been crept in the order dated 09.12.2025. Accordingly, first paragraph shall be replaced as follows:- ''The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 498(A) IPC & Sections 4 of D.P.Act @ under Sections 498(A), 323, 506(i) of IPC (Sections 85, 115, 356 of BNS Act & Section 4 of D.P.Act, in Crime No.01 of 2011 on the file of the respondent police, seeks anticipatory bail. The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under section 498A of IPC (section 85 of BNS Act, 2023) & Section 4 of Dowry Prohibition Act altered into Sections 498(A), 323, 506(i) of IPC (Section 85, 115, 356 of BNS Act) & Section 4 of Dowry Prohibition Act in Crime No. 01 of 2011 on the file of the respondent police, seeks anticipatory bail. After filing charge sheet the same was taken on file in C.C.No.2 of 2014 on the file of The Additional Mahila Court, (Judicial Magistrate Level III),
2. The learned counsel for the petitioner submitted that since the petitioner was absent for one hearing, non bailable warrant was issued on 07.10.2016 and the same is pending. Hence, the present petition.
3.The learned Government Advocate(Crl. Side) submitted that it is a case of jumped out bail and already Non Bailable Warrant was issued against the petitioner by the trial Court. However, he opposed for grant of anticipatory bail to the petitioner.
4. Considering the same, the petitioner is directed to surrender before the trial Court and submit an application to recall the non bailable warrant. On such 4/6
filing, the learned trial Judge shall consider the said application on the same day itself.
5. With the above direction, this Criminal Original Petition is disposed of.
