ORDER
This Criminal Original Petition has been filed to direct the first and second respondents not to harass the petitioners under the guise of enquiry.
2. Considering the limited scope of the relief sought for, notice to the 3rd respondent is dispensed with.
3. The learned counsel appearing for the petitioner would submit that the defacto complainant had lodged a complaint alleging that the first petitioner is the father of her child. Pursuant to the said complaint, the respondent police repeatedly summoned the petitioners for enquiry. She would further submit that the de facto complainant is a married woman and that her marriage is still subsisting. The first petitioner, being an unmarried man and unaware of the de facto complainant's 2/5
marital status, had only maintained a friendship with her. However, he is willing to undergo a paternity test, including DNA analysis, and will cooperate with the investigation. The petitioners have categorically denied the paternity of the de facto complainant's children. In this regard, the petitioners and their family members have been subjected to harassment, and therefore seek protection from this Court.
4. The learned Government Advocate (Crl. Side) appearing for respondents 1 and 2, on instructions, would submit that the first petitioner married the third respondent, and a child was born out of the said wedlock. As per the complaint lodged by the de facto complainant/third respondent, she claims to be the legally wedded wife of the first petitioner and alleges that the first petitioner had not turned up after the birth of their child, which led her to file the present complaint. During the enquiry on 09.12.2025 at about 8.30 p.m., the father of the first petitioner appeared before the police, warmly acknowledged the birth of the child, and expressed his willingness to accept the child as his grandchild.

5. Recording the aforesaid submission, this Criminal Original Petition is disposed of.
