Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the District Revenue Officer, Sivagangai to conduct and conclude the pending enquiry strictly in accordance with the principles of audi alteram partem( natural justice) by affording a fair opportunity to all parties and by examining all original revenue records and to pass final orders.

ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the District Revenue Officer, Sivagangai to conduct and conclude the pending enquiry strictly in accordance with the principles of audi alteram partem ( natural justice) by affording a fair opportunity to all parties and by examining all original revenue records and to pass final orders.

2. With the consent of the parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Heard the learned counsel for the petitioners and the learned Additional Government Pleader appearing for the respondents 1 to 4

4. Since no adverse orders are going to be passed against the respondents 5 and 6 notice to the respondents 5 and 6 is dispensed with.

According to the petitioners they are the sons and legal heirs of late Mohammed Ibrahim, whose ancestral property measuring 1 acre and 42 cents in S.No.184/202 in Thirupathur Village, Sivagangai District devolved upon them During the year 1985, the fifth respondent falsely claimed that Mohammed Ibrahim executed oral Hiba(gift) in his favour. Though Mohammed Ibrahim passed away 13 years earlier, based on this fabricated claim the fifth respondent unilaterally obtained patta mutation, without issuing notice to the petitioners, thereby violating the principles of natural justice and suppressing the rights of other co-heirs. Subsequently he manipulated revenue records and executed a fraudulent settlement deed in favour of the sixth respondent . Aggrieved by the same, the petitioners approached the Revenue Divisional Officer and later this

Court in WP(MD) Nos. 2000 of 2025 and WP(MD) Nos.26306 of 2025. This Court in WP(MD) N.26306 of 2025 directed the authorities to consider the enquiry and pass final orders within a period of twelve weeks from the date of receipt of a copy of this order. Further in WP(MD) No. 26306 of 2025 vide order dated 24.09.2025 directed the fourth respondent not to entertain any document with regard to the subject property for a period of eight weeks. While so, the respondents 5 and 6 are attempting to alienate the property tot he third parties. Hence the present petition.

6. The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that the first respondent concluded the proceedings vide No. g.K.gp.4/15902/2025 dated 02.12.2025 and therefore nothing survives for further adjudication in the present writ petition.

7. If the petitioners are aggrieved for not putting on notice, they are always at liberty to question the order dated 02.12.2025.

8. The Writ Petition stands disposed of with the above observations. No costs.
