Prayer:Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the respondents to permit the petitioner to write 3rd Semester Exam as the arrear papers in the subsequent Semester Exam instead of directing the petitioner to attend class (Read Semester) for another six months to write the 3rd Semester Exam, by considering the representation dated 20.11.2025 within the time stipulated by this Honble Court.

ORDER

The present writ petition has been filed seeking a mandamus directing the respondents to permit the petitioner to appear for the 3rd semester examination as the arrear papers instead of directing the petitioner to attend the classes for another six months to appear for the 3rd semester examination. 2.The petitioner is undergoing M.Sc.Botany in the 2nd respondent college. She has completed first two semesters in the first year. In the 3rd semester, she is having only 35% of attendance. As per Regulation of the 1st respondent University, a candidate who has secured less than 50% attendance, shall not be eligible to appear in the examination and they have to redo the semester after completion of the programme. 3.

In view of the above said University Regulation, a mandamus cannot be issued as against the respondents to permit the writ petitioner to appear for the 3rd semester examination as arrear papers. Permitting the petitioner to appear for the 3rd semester as arrear papers would arise, only if the petitioner has already appeared for the 3rd semester examination and failed in the papers. In the present case, the petitioner is not even qualified to appear for the 3rd semester examination. In such circumstances, the prayer of the writ petitioner is not sustainable.
