Consequently, direct the 2nd Respondent to re-consider the petitioner's representation dated 21.05.2025, seeking cancellation of the Gift Settlement Deed dated 08.07.2008 executed in favour of the petitioner's deceased son Mariyappan, and to restore the title and possession of the property in the name of the petitioner, in accordance with Section 23 of the said Act. O R D E R

The present writ petition has been filed challenging the order passed by the second respondent herein on 21.05.2025 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

2. Under Section 16 of the said Act, appeal would lie to the first respondent. Since the petitioner is having an effective alternative remedy, this Court is not inclined to entertain the present writ petition.

3. The petitioner is at liberty to approach the first respondent by way of filing an appeal. In case, if the appeal is presented on or before 31.12.2025, the same shall be entertained without any reference to the period of limitation. 2/4

4. Granting such liberty, this Writ Petition stands disposed of. There shall be no orders as to costs.
