PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned notice issued by the 1st respondent through in his letter Ref.No.SCN/1051620830/25 dated 28.10.2025 and consequential impugned surrender certificate dated 03.11.2025 and further direct the 1st Respondent to return back the renewed passport to the petitioner bearing No.AH580582 issued on 16.10.2025 through in his File No.TR1075779927625 by way of conforming 1/4

the same, on the basis of the considering the petitioner's explanation/representation dated 19.11.2025 within a time limit stipulated by this Court.

ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent herein wherein the passport of the writ petitioner has been impounded and the consequential order of the first respondent wherein a surrender certificate has been issued.

According to the learned counsel appearing for the writ petitioner, due to dispute between the father and son, the father has lodged a criminal case as against his son in Cr.No.395 of 2022 on the file of the second respondent herein which has culminated in filing of the charge sheet in S.T.C.No.263 of 2024 on the file of the learned District Munsif cum Judicial Magistrate, Peravurani, 2/4

3. According to the learned counsel for the writ petitioner, a look out circular was issued which was challenged by the petitioner in W.P.Crl.(MD)No. 1214 of 2025 and it was allowed on 11.12.2025.

4. He further submits that charge sheet laid before the Court was challenged by him in W.P(MD)No.22158 of 2025 and an order of interim stay has been granted by this Court on 04.12.2025. The request of the petitioner to dispense with his personal appearance before the trial Court has also been granted.

5. In view of the above said facts, the order passed by the first respondent herein impounding the passport is hereby set aside. The first respondent is directed to return the passport to the writ petitioner within a period of two weeks from the date of receipt of a copy of this order.

6. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected writ miscellaneous petitions are also closed. 12.12.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
