O R D E R

This writ petition is filed for Writ of Mandamus to direct the respondents 1 and 2 to initiate necessary action and given adequate protection based on the petitioner's complaint dated 22.11.2025.

2. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents 1 and 2.

3. The petitioner is claiming that his father was the owner of the property and had executed Settlement Deed dated 20.05.1997 in Doc. No.525 of 1997. Thereafter the petitioner had obtained patta in Patta No. 5975. But the private respondents had preferred appeal against the issuance of patta and the same was dismissed vide order dated 01.08.2024. Even of dismissal of appeal, the private respondents trespassed into the petitioner's property and attempted to put up fencing 2/5

in the property. Hence a wordy quarrel arose between the parties and the petitioner had called the police and the private respondents had left the place after police intervention. Since the private respondents had abused the petitioner with filthy language and made life threaten, the petitioner had preferred complaint. But the 2nd respondent had not taken any action. Hence the present petition.

The Learned Counsel appearing for the petitioner submitted that the 3rd respondent had already committed similar occurrence in the year 2013 and a case has been registered in Crime No.63 of 2013 for the offences under section 147, 148, 294(b), 506(2) of IPC and section 3 of TNPPDL Act and charge sheet had been filed in S.C.No.62 of 2024 on the file of Sub Court, Nanguneri and the same is pending for trial.

5. After hearing the rival submissions this Court had given its anxious consideration. It is seen that the petitioner is having patta and the appeal filed by the private respondents was dismissed. If there is any dispute regarding the patta or title over the property the parties are at liberty to resolve the dispute before competent civil court. 3/5

6. As far as the petitioner's complaint dated 22.11.2025 regarding of abuse with filthy language and life threat is concerned, the 2nd respondent ought to consider the same. Therefore, the 1st respondent is directed to consider the complaint and conduct enquiry / investigation. If any criminal offence is made out the respondent is directed to file FIR.
