ORDER

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to conduct a survey, measure, and demarcate the petitioner's lands situated at Kilaathari Village, Sivagangai Taluk, Sivagangai District, comprised in Survey Nos.10/1 - 0.98.00 Ares, 11/2 - 0.35.00 Ares, 12/5 - 0.65.50 Ares, 7/1B - 0.51.50 Ares, and 7/2 - 1.58.00 Ares, by fixing the boundaries as per the records and completing the field measurement within a time frame as may be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, she is the lawful owner of the lands situated in Kilaathari Village, Sivagangai Taluk, Sivagangai District, comprised in Survey Nos. 10/1, 11/2, 12/5, 7/1B, and 7/2, with the respective extents as recorded in the

revenue documents. Despite repeated representations, the respondents have not conducted the survey, measurement, and demarcation of the petitioner's lands, resulting in uncertainty regarding the exact boundaries and causing hardship to the petitioner. The petitioner is entitled to have his land surveyed and the boundaries fixed as per the existing revenue records, which is a statutory duty cast upon the respondents. The inaction of the respondents is arbitrary and violative of the petitioner's rights, necessitating the intervention of this Court. Hence, the present Writ Petition.

4. The learned Government Advocate appearing for the respondents would submit that after consideration of the claims of both the parties, proper steps would be taken to demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents 2 and 3 to consider the representation of the petitioner dated 07.05.2025 and demarcate the land of the petitioner, after consideration of the claims of both the parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu

Survey and Boundaries Act, 1923, within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
