ORDER
The present Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order dated 16.03.2023 passed by the first respondent, quash the same as illegal, and consequently direct the respondents to defreeze the petitioner's bank account bearing A/c. No.1345101008216 on the file of the second respondent.
2. The learned counsel appearing for the second respondent submitted that, due to the pendency of a criminal case under the NDPS Act, the bank has frozen the account of the petitioner. He further submitted that the petitioner has availed a jewel loan, which aspect ought to be taken into consideration while considering the request for defreezing the account. The same is recorded. 2/5
3. Heard the learned counsel on either side.
4. Considering the fact that the petitioner has availed a jewel loan in the said bank, the second respondent bank is directed to consider the claim of the petitioner in accordance with law. The said exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
