Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus directing the respondents No.1 to 3 to conduct an enquiry and to take appropriate action against the 5th respondent on the basis of the petitioner's representation dated 27.08.2025 within the time stipulated by this Court.

ORDER

This Writ Petition has been filed to direct the respondents 1 to 3 to conduct an enquiry and take appropriate action against the fifth respondent on the basis of the petitioner's representation dated 27.08.2025.

2. The learned counsel appearing for the petitioner would submit that the petitioner has given a representation on 27.08.2025 to conduct an enquiry and to take appropriate action against the fifth respondent. However, the same is yet to be considered. Hence, the Writ Petition. 2/5

3. The learned Special Government Pleader appearing for the respondents 1 to 4 would submit that no direction can be issued to initiate disciplinary action against the official respondents.

4. I have given due consideration to the submissions made on either sides.

5. Mere direction to dispose of the representation is not compelling the Authorities to initiate disciplinary action against the fifth respondent. The petitioner is only bringing to the knowledge of the Department about the misdeeds of the fifth respondent. At the best, the Authorities can make use of the information in the representation of the petitioner for the purpose of initiating disciplinary action and it is up to the Departmental Authorities to initiate disciplinary action against the fifth respondent.

6. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the respondents 1 to 3 to consider the representation of the petitioner dated 27.08.2025 and dispose of the same, on their own merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. 3/5

7. With the above direction, this Writ Petition stands disposed of. No costs.
