To enlarge the petitioners on bail in the event of arrest or upon their surrender under S.C. No. 6 of 2023, on the file of the respondent police and thereby render justice.

ORDER : The Court made the following order :- 1/6

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191, 191(3), 332, 294, 127, 109 & 351 of BNS 2023, (Corresponding sections 147, 148, 449, 294(b), 342, 307 and 506(2) of IPC) in Crime No.1411 of 2020 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the due to previous motive, the petitioner along with other accused persons trespassed into the house of the defacto complainant and abused the defacto complainant and her family in filthy language and attacked her son with deadly weapons and caused injuries. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any 2/6

conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) submitted that the injured person has been discharged from the hospital and there are 11 previous case pending against the petitioner and the charge sheet has been filed and taken on file in C.C.No.06 of 2023 on the file of the learned Additional Chief Judicial Magistrate, Madurai. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, inspite of 11 previous cases pending against the petitioner, since charge sheet has been filed, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his 3/6

appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional Chief Judicial Magistrate, Madurai, within a period of fifteen days from the date on which the order copy is made ready and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity;

[b]the petitioner shall report before the trial Court daily at 10.30 a.m, for a period of one week and thereafter as and when required and for all hearings before the trial Court;

[c]the petitioner shall not tamper with the evidence or witness either during investigation or trial;

[d]the petitioner shall not abscond either during investigation or trial;

[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
