ORDER

This Civil Revision Petition has been filed challenging the fair and decreetal order passed in I.A. No.3 of 2025 in O.S. No.32 of 2024, dated 10.11.2025, by the District Munsif, Mudukulathur.

2. The only grievance expressed by the learned counsel appearing for the revision petitioner is that the e-Courts status reflects that I.A.No.3 of 2025 in O.S. No.32 of 2024 was dismissed with no costs, whereas, the very same petition was allowed on condition of payment of costs of Rs.500/- to the respondents on or before 20.11.2025. Challenging the same, the present revision petition has been filed.

3. The learned counsel for the respondent submitted that the revision petitioner is yet to file his written statement before the trial Court.

4. The original prayer in the suit was for declaration and permanent injunction. Subsequently, an amendment application was filed to include the relief of recovery of possession and the same was allowed by the trial Court on the ground that the amendment could be permitted 2/4

to prevent multiplicity of proceedings, unless it appears to be barred by limitation. The trial Court further observed that any hardship caused to the respondents could be compensated by costs and that no specific plea had been raised to show that the proposed amendment was barred by limitation.

5. Considering the findings of the trial Court, this Court finds no infirmity in the order passed by the trial Court. Hence, this Civil Revision Petition is dismissed. Consequently, the connected Miscellaneous Petition is closed. No costs.
