Prayer : Civil Miscellaneous Petition is filed to permit the petitioners/Respondents 1 to 4 to withdraw their respective shares of the award amount deposited by the 1st Respondent/Appellant in M.C.O.P. No.1138 of 2023 on the file of the Motor Accident Claims Tribunal/Special District Court to deal with Motor Accidents Cases, Madurai.

ORDER

This Civil Miscellaneous Petition has been filed seeking permission for the petitioners/respondents 1 to 4 to withdraw their respective shares of the award amount deposited by the 1st respondent/appellant in M.C.O.P.No.1138 of 2023 on the file of the Motor Accident Claims Tribunal / Special District Court to deal with Motor Accident Cases, Madurai.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The learned counsel for the 1st respondent submitted that 50% of the award amount may be ordered to be withdrawn by the petitioners. 2/4

4. Considering the facts and circumstances of the case and being satisfied with the reasons stated in the affidavit, this Court is inclined to allow this petition.

5. Accordingly, this Civil Miscellaneous Petition is allowed. The petitioners are permitted to withdraw 50% of their respective shares of the award amount, along with proportionate interest and costs, by filing necessary application before the Motor Accident Claims Tribunal / Special District Court to deal with Motor Accident Cases, Madurai. 08-01-2026 mkn 3/4
