ORDER

This Criminal Original Petition has been filed to direct the learned Special Court for Exclusive Trial of cases under SC/ST (POA) Act, Dindigul to accept the surrender of the petitioner and to consider the petitioner's bail application on the date of surrender itself in Crime No.323 of 2025, on the file of the second respondent.

2.Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3.The case of the prosecution is that on 02.12.2025, when the third respondent was cutting a tree in Siva's agricultural land, the petitioner went there and claimed that the tree stands in a

disputed property and abused the third respondent using his caste name and had pelted stone on the third respondent, by which the third respondent fell down from the tree and got injured. Hence the complaint.

4.Learned Government Advocate [Crl. Side] appearing for the respondents 1 & 2 would submit that the injured has been discharged from the hospital.

5.Heard the learned counsel on either side and carefully perused the materials available on record.

6.Considering the limited scope of the relief sought for and also considering the fact that the injured has been discharged from the hospital, this Court directs the learned Special Judge, Special Court for Exclusive Trial of cases under SC/ST (POA) Act, Dindigul, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.323 of 2025, on the file of the 2nd respondent police.

7.Accordingly, this Criminal Original Petition is disposed of. 17.12.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No MR
