ORDER

This Criminal Original Petition has been filed to direct the 1st respondent to transfer the investigation in Crime No. 11/2025 on the file of the 4th respondent to any other competent officer or CBCID specialized agency in order to conduct proper investigation and to cull out the truth.

2. The First Information Report in crime No.11 of 2025 is a POCSO case in which a minor victim girl of age 14 was subjected to penetrative sexual assault by the accused persons. Being dissatisfied by the investigation conducted by the 4th respondent, this Criminal Original Petition is filed.

3. When the matter came up for hearing, the learned Government Advocate (Crl. side) Mr.M.Sakthi Kumar, on 2/5

instructions, submitted that already the investigation has been completed and 164 statement has been duly recorded by the learned District Munsif-cum-Judicial Magistrate, Avudaiyarkoil, on 26.09.2025, and the final report is also filed. After filing, the final report was taken on file in Spl.S.C.No.116 of 2025 before the learned Mahila Court, Pudukkottai. At this juncture, the question of transferring the investigation will not arise.

4. Despite the said submission, the victim girl was required to appear before this Court and the victim girl appeared before this Court today. After interaction, I don't find any demerit in the investigation conducted by the 4th respondent.

5. In view of same, it is not necessary to transfer the investigation at this stage.

6. Accordingly, this Criminal Original Petition is dismissed. 20.01.2026 NCC : Yes / No Index : Yes / No Internet : Yes/ No 3/5
