Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari calling for the records relating to the impugned show cause notice in proceedings Na.Ka.No. 7001/A2/2025 dated 25.11.2025 issued by the 2nd respondent, quash the same as illegal and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER

The present writ petition has been filed challenging a show cause notice issued by the 2nd respondent dated 25.11.2025.

2. Mr.N.Satheesh Kumar, learned Additional Government Pleader takes notice on behalf of the respondents 1 and 2. Mr.K.R.Badrus Zaman, learned Government Advocate takes notice on behalf of he 4th respondent. 2/6

3. A perusal of the impugned notice reveal that it has been issued invoking Section 34 of the Tamil Nadu Recognized Private Schools (Regulation) Act, 1973 and Tamil Nadu Urban Local Bodies Act, in order to take over the school.

4. According to the learned counsel appearing for the petitioner, such power is vested only with the Government and District Educational Officer cannot issue such a show cause notice.

5. The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the intention of the 2nd respondent was to issue a show cause notice only for imposing direct payment system, however, erroneously Section 34 of the Tamil Nadu Recognized Private Schools (Regulation) Act, 1973 has been mentioned.

6. In view of the above said facts, the show cause notice dated 25.11.2025 stands quashed. However, the 2nd respondent would be at liberty to initiate any further proceedings after issuing proper notice to the necessary parties.
