ORDER

This Criminal Original Petition has been filed to direct the learned Special Court for Exclusive Trial of Cases under SC/ST Act Cases (PCR Court), Thoothukudi, to accept the surrender of the petitioner/ A1, in connection with the case in Crime No.803 of 2025, on the file of the 2nd respondent police and to consider their bail application on the same day of surrender.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The petitioner submits that the case arises out of a political dispute. On 31.11.2025, following the Ottapidaram MLA's visit to inspect the damages caused due to the rain water and his assurance to address the water stagnation, the petitioner and the other accused went to the defacto complainant's locality and undertook removal of the 2/5

stagnant water using a motor and lorry. It is alleged that when the defacto complainant requested that a wall be constructed to prevent further stagnation, an altercation occurred between the petitioner and the de facto complainant, leading to the petitioner allegedly scolding and assaulting the de facto complainant. Based on these allegations, an FIR has been registered against the petitioner.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned Special Court for Exclusive Trial of Cases under SC/ST Act Cases (PCR Court), Thoothukudi, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.803 of 2025 on the file of the 2nd respondent police.
