Common Prayer: Writ Petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned Refusal Check Slip issued by the respondent in RFL/Illupur/134 and 135/2025 dated 18.11.2025, quash the same as illegal and consequently direct the respondent to register the sale deed presented by the petitioners within the time stipulated by this Court.

Govt Pleader in W.P.(MD)No.35465/2025 COMMON ORDER These Writ Petitions are filed challenging the impugned Refusal Check Slips in RFL/Illupur/134 and 135/2025 dated 18.11.2025, issued by the respondent and also seeking for a consequential direction directing the respondent to register the settlement deed presented by the petitioners, within the time stipulated by this Court.

2. Mr.A.Kannan, learned Additional Government Pleader takes notice for the respondent in W.P.(MD)No.35430 of 2025 and Mr.M.Lingadurai, learned Special Government Pleader, takes notice for the respondent in W.P.(MD)No.35465 of 2025. By consent, this Writ Petitions are taken up for final disposal.

3. It is the grievance of the petitioners that when the petitioners presented sale deeds for registration, the same were refused to be registered on the ground that there are double entries in respect of the same properties. Challenging the same, the petitioners have filed these Writ Petitions.

4. The learned Additional Government Pleader and the learned Special Government Pleader appearing for the respondent would submit that since there was double entries in respect of the same properties, the impugned refusal check slips were issued by the respondent.

5. On a perusal of the records, it is seen that, one Jayachandran, having obtained a total extent of 0.70.0 hectares through oral allotment from his father, had sold an extent of 0.39.5 hectare to his brother Gopal Naidu. In the remaining land, he appointed one Kathamuthu as his power of attorney, who in the year 2009, sold about 0.30.50 hectare to one Mohammed Iqbal from whom, the petitioners purchased the property. In view of the above, this Court is of the view 3/6

that there is no question of double entries. Hence, the impugned orders are liable to be set aside.

6. Accordingly, these Writ Petitions are allowed and the impugned refusal check slips issued by the respondent dated 18.11.2025 are set aside. The petitioners are directed to represent the sale deeds and upon representation of the same, the respondent is directed to register the sale deeds immediately.
