O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus challenging the impugned orders dated 11.10.2025 bearing Reference No.2025/N103/23/016773 and dated 05.11.2025 bearing Reference No.2025/N103/23/017396 passed by the third respondent rejecting the petitioner's request for transfer of patta in respect of the land in Survey No.656/3, situated at Arasanur Village, Sivagangai Circle, Sivagangai District and consequently directing the respondents to issue patta in the name of the petitioner.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

The learned counsel appearing for the petitioner would submit that the subject property was purchased by the petitioner's grandmother vide a Sale Deed dated 15.03.1974; that since the petitioner had fully taken care of his grandmother, she settled the property in favour of the petitioner vide a Gift Deed dated 04.12.2012; that based on the same, the petitioner submitted an application for transfer of patta; and that however, the third respondent rejected the same without assigning any reasons.

The learned Government Advocate appearing for the respondents would fairly submit that the impugned orders have been passed rejecting the request for transfer of patta without assigning any reasons; and that if this Court deems it fit, the rejection may be set aside and the matter may be remitted back to the third respondent for reconsideration and for passing a reasoned order.
5. A perusal of the impugned orders rejecting the petitioner's request for transfer of patta clearly reflects that no reasons have been assigned for such rejection. The third respondent ought to have given reasons, either for acceptance or rejection of the request, by way of a speaking order. Since the third respondent has failed to assign reasons in Page No. 3 of 6
the impugned orders, the same are liable to be set aside and are accordingly set aside. However, the third respondent is at liberty to pass a fresh order assigning reasons either accepting or rejecting the request, if any. It is needless to state that before passing any such order, the petitioner and any other interested parties who may be affected by the said order shall be put on notice and afforded sufficient opportunity of hearing.
6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
