ORDER : The Court made the following order :- The petitioners, who were arrested and remanded to judicial custody on 21.10.2025, 20.11.2025 and 07.11.2025 respectively for the offences punishable under Sections 191(2), 191(3), 296(b), 115(2), 118(1) and 351(3) of the BNS, 2023 @ Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(3) and 103 of the BNS, 2023 8(c), in Crime No.514 of 2025 on the file of the respondent police, seek bail.

The case of the prosecution is that the defacto complainant had earlier insisted that A1 purchase liquor for him, which was informed to the defacto complainant's paternal father, who thereafter beat him. Since then, there had been enmity between the parties. On 19.10.2025, at about 08.30 p.m., while the defacto complainant was passing in front of A1's house, the accused persons allegedly waylaid him, abused him in filthy language, attacked him with wooden logs, caused bleeding injuries, and threatened him with dire consequences. Thereafter, the defacto complainant and his paternal father were taken to the Government Hospital, Kanavilakku, through the 108 Ambulance for treatment and were admitted as in-patients. Subsequently, the paternal father of the 2/6
defacto complainant succumbed to the injuries. Hence the present case.
3. The learned counsel for the petitioner submitted that the petitioners are innocent persons and they have not committed any offences as alleged by the prosecution. He further submitted that the petitioners have been in judicial custody from 21.10.2025, 20.11.2025 and 07.11.2025, respectively. Hence, he prayed for grant of bail to the petitioners.
4. The learned Additional Public Prosecutor submitted that A3 and A5 have already been granted bail by this Court. He further submitted that there are no previous cases against the petitioners. However, he opposed the grant of bail to the petitioners.

Taking into consideration the facts and circumstances of the case, the fact that the co-accused have already been released on bail by this Court, and also the period of incarceration suffered by the petitioners, this Court is inclined to grant bail to the petitioners, subject to the following conditions:

Accordingly, the petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Aundipatty, and on further conditions that :- [a] the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity.
[b] the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders. They have to co-operate for the investigation.
[c] the petitioners shall not tamper with the evidence or witness either during investigation or trial. [d] the petitioners shall not abscond either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned 4/6
Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
