PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 3rd respondent to provide adequate police protection to construct the house based on the gift deed executed by the petitioner in favor of the 4th respondent bearing Document No. 2540 of 2025 dt. 06.06.2025 based on the petitioner's representation dated 21.11.2025 for the petitioner's life and limb which is guaranteed by the constitution of India and the Tamil Nadu Maintenance and Welfare of Parents and Senior Citizenship Rules Act.

O R D E R

This writ petition has been filed seeking a Writ of Mandamus to direct the 3rd respondent to consider the representation of the petitioner dated 21.11.2025.

2. This Court suo motu impleads the Revenue Divisional Officer, Sellur, Madurai District, as the 6th respondent. 2/6

3. The contention of the petitioner is that she is aged about 85 years and is the absolute owner of the subject property. She had adopted a son, but died. The grandson, namely the 5th respondent, is creating serious problems for the petitioner. The petitioner has already executed a gift deed in favour of the 4th respondent, who is her daughter. The petitioner intended to put up a new construction after demolishing the existing dilapidated structure. However, the 5th respondent has been preventing her from doing so. It is further stated that the 5th respondent is involved in three criminal cases, is a notorious rowdy, and has been interfering with and threatening the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for respondents 1 to 3 submitted that the petitioner ought to have approached the Revenue Divisional Officer for appropriate relief under the provisions of the Senior Citizens Act.

5. Considering the submissions made, the petitioner is directed to submit a fresh application to the 6th respondent / Revenue Divisional Officer, within a period of one week from the date of receipt of a copy of 3/6

this order. Upon receipt of such application, the Revenue Divisional Officer, Sellur, Madurai District, is directed to consider the same under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act and provide appropriate protection to the petitioner in the manner known to law. If a case is made out under criminal law, the respondents 1 to 3 are directed to proceed with criminal action.

6. With the above directions, this writ petition (Criminal) is disposed of.
