Respondents Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to transfer the investigation from the fifth respondent Office to the fourth respondent office for conducting fair and impartial investigation in Crime No.95 of 2025 on the file of the fifth respondent and subsequently, directing the first respondent under the supervision in this case within a time fixed by this Court.

ORDER

This Criminal Original Petition has been filed seeking a direction to the first respondent to transfer the investigation in Crime No.95 of 2025, on the file of the fifth respondent Police, to the fourth respondent.

2. The learned counsel for the petitioner submitted that the FIR was registered on 27.10.2025. However, no tangible progress has been made in the investigation so far, owing to the absence of the Investigating Officer from the fifth respondent Police Station. He 2/6

further submitted that the deceased was a public-spirited person, who had been actively contributing towards the welfare of the voiceless sections of society, and therefore, the indulgence of this Court is required to ensure a speedy and effective investigation.

3. Per contra, the learned Government Advocate (Criminal Side), appearing for the respondent Police, on instructions, submitted that the Investigating Officer was not absent deliberately, but had gone for training at the Police Academy. It was further submitted that there was no lapse on his part and that, he has since resumed duty on 15.12.2025.

4. Heard the learned counsel appearing on either side and carefully perused the materials available on record.

5. Considering the nature and gravity of the offence involved, this Court is of the view that the third respondent shall monitor the ongoing investigation being conducted by the fifth respondent. The fifth respondent is directed to appraise the third respondent of the progress 3/6

of the investigation on a weekly basis, every Friday, and to conclude the investigation as expeditiously as possible, in accordance with law.

6. With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed.
