PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of CERTIORARIFIED MANDAMUS to call for the records relating the impugned order passed by the 3rd respondent in his Ka.No.Se.Po/ Pe.Me.Ka/Thiru/Ko.Mupandhal/110KV Minpathai/No.223/25 dated 10.07.2025 and consequential order passed by the 2nd respondent in Na.Ka.M3/No. 3632386/2025 dated 28.10.2025 and to quash the same and to direct the respondents to consider the petitioner representation dated 28.11.2025 and to grant appropriate compensation to the petitioner land prevailing market value by fixing the compensation.

ORDER

The present writ petition has been filed challenging an order of compensation passed by the third respondent herein for putting up power line in the private property of the writ petitioner. A consequential order has been passed by the second respondent herein granting enter upon permission to the electricity board to erect the power line.

2. According to the learned standing counsel appearing for the respondents 1, 3 and 4, it is Mupandhal power line project undertaken by the Government. In case, the petitioner is aggrieved over the quantum of compensation, he has to approach the District Court seeking enhancement of compensation as provided under Section 16(4) of the Indian Telegraph Act.

3. In view of the above said submission, it is made clear that the petitioner cannot challenge the quantum of compensation by way of filing the writ petition. Therefore, the petitioner is at liberty to approach the District Court concerned by filing an appeal seeking enhancement of compensation.

4. As far as the order granting enter upon permission is concerned, the same shall be disposed of by the respondent authorities only after remitting the compensation amount as determined by the third respondent.

5. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 12.12.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/5
