JUDGMENT
(Judgment of the Court was delivered by N. ANAND VENKATESH, J.) This appeal has been filed by the husband against the judgment in HMOP No.333 of 2023 dated 26.09.2025 on the file of the family Court, Tiruchirappalli, mainly on the ground that the petition was disposed of based on the settlement that was arrived at between the parties, but, however, certain adverse remarks were made in the judgment while deciding the issue numbers 1 and 2.
2. Heard the learned counsel for the appellant and the learned counsel for the respondents.
3. On carefully going through the judgment passed by the family Court, it is seen that the same has been disposed of based on the settlement between the parties. In this process, certain adverse remarks have been made by the family Court Judge, while deciding the issues 1 and 2.
4. In our considered view, those adverse remarks may not be warranted in this case since ultimately the petition itself was disposed of based on the settlement between the parties. Hence, the adverse remarks that have been made with regard to issue Nos.1 and 2, more particularly in Paragraph No.24 to 26, shall stand eschewed.
