Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing to the Respondents especially 2nd respondent herein to forthwith dismantle and disconnect the service connection illegally effected on 17.11.2025 in favour of the 5th respondent, in respect of the petition-mentioned property in T.S.R.No.1516, Kumbakonam, by considering her representation, dated 22.11.2025 and consequently, direct the respondents not to grant any fresh electricity service connection to the said property until the disposal of the said civil suit.

O R D E R

The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the second respondent to dismantle and disconnect the electricity service connection effected on 17.11.2025 in favour of the fifth respondent, in respect of the property in T.S.R. No. 1516, Kumbakonam, by considering her representation dated 22.11.2025. 2.The fifth respondent claims to be a subsequent purchaser of the property and, for the purpose of putting up construction, applied for a temporary electricity service connection, which was granted by the second respondent. the meantime, the petitioner has filed a suit for declaration to declare the sale deed in favour of the vendor of the fifth respondent as null and void. During the pendency of the said suit, the service connection was provided to the fifth respondent. It is also brought to the notice of this Court that the petitioner has obtained an order of temporary injunction on 13.03.2026 restraining the fifth respondent from proceeding with further construction. 3.Since the dispute between the parties regarding title and possession is already pending before the competent civil court, this Court is not inclined to entertain the petitioner's request for disconnection of electricity at this stage. 4.Accordingly, the writ petition is disposed of, granting liberty to the petitioner to work out her remedies before the civil court in the pending suit. It is made clear that the temporary service connection granted to the fifth respondent shall be subject to the outcome of the said suit. No costs.
