O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 08.08.2025 in respect of the land comprised in Survey No. 275/1B1, measuring an extent of 4 acres, situated at Vembaar Village, Vilathikulam Taluk, Tuticorin District.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner submits that the petitioner purchased the land comprised in Survey No.275/1B1, situated at Vembaar Village, Vilathikulam Taluk, Tuticorin District, from his own brother; that the name of the petitioner was included in Joint Patta No.187 along with others; that even in the computerized revenue records for the years 2015, 2019, 2020 and 2025 in respect of the said property, the name Page No. 2 of 5
of the petitioner appeared; that recently, the petitioner's name has been deleted without issuing any notice to the petitioner, without conducting any enquiry and without passing any speaking order, and that the names of one Balasubramanian and Nandhini, who do not have any title deed, possession or legal right or basis to claim the property, were included; that thereafter, the petitioner submitted a representation dated 08.08.2025 to the respondents; and that since the said representation did not evoke any response, the present writ petition has been filed.
4. The learned Government Advocate appearing for the respondents submits that the enquiry is pending with the third respondent and that the petitioner's representation will be considered on its own merits and in accordance with law.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 08.08.2025 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and Page No. 3 of 5
disposed of after conducting an enquiry. The third respondent is also directed to provide reasonable opportunity during such enquiry to the petitioner and to any others who may be affected by such decision. There shall be no order as to costs.
