ORDER

The petitioner is working as a Superintendent in the Sericulture Department, Dindigul. By the impugned order, the petitioner has been transferred from Dindigul to Pennagaram, Dharmapuri District. Aggrieved by the same, the petitioner has filed the present petition. 2.The learned counsel appearing for the petitioner submits that the petitioner is a divorcee living with her old-age parents and she is also having a 13 year old minor son, who is studying 7th std at Dindigul. Since this impugned order has been passed in the middle of the academic year, that too, punitive in nature, the petitioner has filed this writ petition challenging the transfer order. According to the learned counsel for the petitioner, the petitioner was transferred by the order dated 24.11.2024 and on the very same day, she was 2/6

also issued with the charge memo that she has not performed to their expectation. Since the charge memo has also been issued on the date of issuance of transfer order, it is in punitive nature. 3.Earlier, on 10.12.2025, this Court while entertaining this petition has granted an order of interim stay.

4.The learned Special Government Pleader appearing for the official respondents submits that this Court has granted the order of interim stay, on 10.12.2025. Even before that, the fourth respondent has joined the duty, on 08.12.2025. He further submits that the transfer order is not in the form of punitive in nature, however, it is passed only on the administrative grounds. 5.Considering the fact that the petitioner is a divorcee and her old-age parents are also depending on her, this Court suggested the respondents to accommodate her in any of the places nearest to Dindigul District. The learned Special Government Pleader has also verified the possibility with the Officers, who have assisted him. One Mr.Ilayaraja, Assistant Director, who is present before this Court, submits that the suggestion of this Court has also been conveyed to the Director of Sericulture Department and the Director is ready to 3/6

accommodate the petitioner, as and when any vacancy arise in the nearest place to Dindigul District. According to the Assistant Director, probably in the month of January 2026, vacancies will arise and they will accommodate the petitioner at the nearby place, in the month of January, 2026. 6.Recording the above submission, this writ petition is closed with a direction to the respondents to accommodate the petitioner in any place, nearer to Dindigul, as and when the vacancy arises, either in the month of January, 2026 or in the month of of February, 2026. No costs. Consequently, connected miscellaneous petition is closed.
