ORDER

This writ petition has been filed seeking the issuance of a Writ of Mandamus, directing the third respondent to mutate patta in the name of the petitioner based on the settlement deed executed in favour of the petitioner in Doc.No.304/2007 dated 18.01.2025, by considering the petitioner's Application No.2025/0153/24/007816 dated 02.08.2025, within stipulated time fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the petitioner is entitled to the patta in respect of the property by virtue of the settlement deed executed in her favour in Doc.No.304/2007 dated 18.01.2025. Despite having submitted Application No.2025/0153/24/007816 dated 02.08.2025, the third respondent has not mutated the patta in the petitioner's name. It is submitted that such inaction is causing prejudice to the petitioner. Therefore, the petitioner seeks

a direction to the third respondent to mutate the patta in her name within the time stipulated by this Court, in accordance with law.

4. The learned Special Government Pleader for the respondents submits that the petitioner's application will be considered on its merits and in accordance with law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's application dated 18.01.2025, on merits and pass appropriate orders in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The application shall be considered and disposed of after conducting an enquiry. The third respondent is directed to provide reasonable opportunity during such enquiry to the petitioner and also to the other persons, who may be affected by such decision. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.)
