ORDER

The present writ petition has been filed seeking seeking to quash the orders passed by the 1st respondent herein, wherein the petitioner has been called upon to furnish clarification with regard to the adverse police remarks received in respect of the petitioner's passport application.

2. A perusal of the records reveal that the petitioner has been implicated in a criminal case in Cr.No.235 of 2025, on the file of the Mayanoor Police Station, Karur District for the alleged offence under Sections 281, 125(a) and 106(1) of BNS.

3. The learned Government Advocate appearing for the 2nd respondent would submit that the investigation has not been completed and so far charge sheet has not been laid.

4. This Court in a judgment reported in 2014 8 MLJ 61 has held that mere pendency of FIR would not be a legal impediment for issuance of passport.

5. In view of the above said facts, the 1st respondent is directed to consider the application of the petitioner and pass orders within a period of four weeks from the date of receipt of a copy of this order.

6. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
