ORDER
This writ petition has been filed challenging the award passed in Lok Adalat Award bearing PLA/B/No.12 of 2025 dated 09.09.2025 on 2/5
the file of the 2nd respondent on the ground that the same is arbitrary, illegal and without any legal basis and consequently direct the 2nd respondent to relegate the parties to Competent Civil Court concern.
2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself. Since no adverse orders are going to be passed against the private respondents, notice is dispensed with.
3. The petitioner has challenged the award passed in the Lok Adalat. He would submit that no compromise is reached before the lok adalat.
4. The learned Government Advocate would however submit that the writ petition is not at all maintainable as the award passed by the Lok Adalat cannot be challenged before the writ jurisdiction by invoking Article 226 of the Constitution of India. She would further submit that challenging the said award, one of the party has approached the civil 3/5
Court by filing a suit.
5. Considering the submission made on either side, this Court is not inclined to entertain the writ petition. It is open to the petitioner to challenge the award in the manner known to law. Accordingly, the writ petition is dismissed. No costs. Consequently connected Miscellaneous Petitions are closed.
