PRAYER :- C-31M.To set aside the order dated 26.09.2025 passed by the Principal Sessions Judge, Kanyakumari District at Nagercoil in Crl.M.P.No.3659 of 2025 insofar as the petitioner is concerned and to modify the order of condition No.(i) in para 7 imposed on the petitioner in Crl.M.P.No.3382 of 2025 dated 09.09.2025 by permitting the petitioner to produce sureties before any competitive court outside Kanyakumari District.

ORDER : The Court made the following order :- This petition has been filed to set aside the order dated 26.09.2025 passed by the learned Principal Sessions Judge, Kanyakumari District at Nagercoil in Crl.M.P.No.3659 of 2025 insofar as the petitioner is concerned and consequently to modify the order of condition No.(i) in para 7 imposed on the petitioner in Crl.M.P.No.3382 of 2025 dated 09.09.2025 on the file of the learned Principal Sessions Judge, Kanyakumari District at Nagercoil.

2. Heard the learned counsel on both sides.

3. The learned counsel for the petitioner submitted that since the petitioner is a practicing advocate before the learned Judicial Magistrate No.I, Kuzhithurai, the bar is not cooperating. Therefore, the petitioner has filed a petition seeking to modify the condition imposed by the learned Principal Sessions Judge, Kanyakumari District at Nagercoil. However, the trial Court has dismissed the same. 2/4

Aggrieved over the same, the present petition has been filed to modify the condition.

Considering the nature of the offence, and since the petitioner is a practicing advocate, the condition imposed by the learned Principal Sessions Judge, Kanyakumari District at Nagercoil in Crl.M.P.No.3382 of 2025 is hereby modified to the effect that the petitioner shall appear before the learned Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District, daily at 10.30 a.m, until further orders. The other conditions imposed by the trial Court is confirmed.
