O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the third respondent to dispose of the petitioner's application dated 03.11.2025, submitted for issuance of patta in respect of the petitioner's property comprised in New Survey No.635/9 and New Survey No. 635/10, measuring an extent of 9 cents, situated at Visavanoor Village, Ilayangudi Taluk, Sivagangai District, within the time stipulated by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner submits that the petitioner is the Secretary of Masjithul-Hutha Uravin Murai Sunnat Jamath Mosque, Visavanoor, Ilayangudi Taluk, Sivagangai District Page No. 2 of 5
(hereinafter referred to as "the Mosque"); that the erstwhile administrators of the Mosque purchased land situated near the Mosque, comprised in part of Old Survey No. 465/1 and New Survey Nos. 635/5, 635/9 and 635/10, totally measuring an extent of 18 cents; that the third respondent has issued patta only in respect of the land in Survey No. 635/5 measuring an extent of 9 cents; that the remaining lands in Survey Nos. 635/9 and 635/10 have been wrongly classified as Natham Poramboke; that though the administrators of the Mosque have repeatedly attempted to rectify the said mistake, the third respondent has not taken any steps in this regard; that the petitioner submitted a detailed representation/application dated 03.11.2025, enclosing all relevant documents, to the respondents; and that since the respondents have not considered the same, the present writ petition has been filed.
4. The learned Government Advocate appearing for the respondents submits that the petitioner's representation/application will be considered on its own merits and in accordance with law.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a Page No. 3 of 5
direction to the third respondent to consider the petitioner's representation/application dated 03.11.2025 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation/application shall be considered and disposed of after conducting an enquiry. The third respondent is also directed to provide reasonable opportunity during such enquiry to the petitioner and to any others who may be affected by such decision. There shall be no order as to costs.
