PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the respondents 3 and 5 from making any transfer of patta or survey in respect of the petitioner's lands bearing in S.Nos. 135/1, 136/1, 136/2, 136/3, 136/4, 136/5, 136/6, 136/7 and 140/6, Senkattampatti Village, Nilakottai Taluk, Dindigul District, compromised in Patta No.562, without following due process of law by considering the petitioner's representation dated 20.11.2025 within time stipulated by this Court. ORDER

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus, forbearing the respondents 3 and 5 not to make any transfer of patta or survey in respect of the petitioner's lands bearing S.Nos.135/1, 136/1, 136/2, 136/3, 136/4, 136/5, 136/6, 136/7, and 140/6, Senkattampatti Village, Nilakottai Taluk, Dindigul District, comprised in Patta No.562, without following due process of law and without considering the petitioner's representation dated 20.11.2025, within the time stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the sixth respondent, notice to the sixth respondent is hereby dispensed with.

4. According to the petitioner, he has submitted a representation dated 20.11.2025 requesting the respondents 3 and 5 not to make any transfer of patta or survey in respect of the petitioner's lands. However, the sixth respondent has made an application for Patta transfer and survey to create encumbrance over the petitioner's properties. Any transfer of the said lands without due process of law and without considering the petitioner's representation would cause irreparable harm and violate the petitioner's legal and equitable rights.

5. The learned Government Advocate appearing for the respondents 1 to 5 submits that the petitioner's representation will be considered and appropriate orders will be passed in accordance with law, within a time frame to be fixed by this Court.

6. Recording the above submissions, this Writ Petition is disposed of, with a direction to the third respondent to consider the representation of the petitioner, dated 20.11.2025, on merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner, the sixth respondent, as well as all other persons, who may be interested in the subject matter, within eight weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the third respondent to consider the same on its own merits. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.)
