ORDER

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 2 and 3 to rectify the error in their Town Survey Register and other revenue documents in so far as an extent to the petitioner's property in New S.No.215, Old S.No.87/6 of Block No.19, Ward 23, Ponmeni, Kokkulappai, Madurai Corporation , Madurai West, Madurai within a time framed as fixed by this Court.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, his father died on 22.11.2006 and thereafter he came to know that in the Town Survey Register and its extract the extent of

their property was wrongly entered as 0.374.5 sq.mts instead of 10 cents and the above error happened during Natham Land Tax Survey held in the year 19972007. In order to rectify the same the petitioner has made a representation to the respondents through post as well in person. After considering the representation the second respondent vide proceedings dated 20.11.2024 directed the third respondent to conduct enquiry and file a report . But the third respondent has not taken any steps so far.

4. The petitioner submits that the respondents are duty-bound to consider and dispose of the representation within a reasonable time, and the prolonged delay is arbitrary and unjustified. Hence, the present Writ Petition.

5. The learned Government Advocate for the respondents 1 to 3 submits that the petitioner's representation will be considered on its merits and in accordance with law.

6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to rectify the error in their Town Survey Register and other

revenue documents in so far as an extent to the petitioner's property in New S.No.215, Old S.No.87/6 of Block No.19, Ward 23, Ponmeni, Kokkulappai, Madurai Corporation , Madurai West, Madurai on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The third respondent is directed to provide reasonable opportunity during such enquiry to the petitioner and also to the other persons, who may be affected by such decision. There shall be no order as to costs.
