PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 2 & 3 herein to survey and demarcate the land comprised in S.Nos.59/14, 59/19, 59/26, 59/28, 59/30, 59/31, 59/32, 59/36 and 59/44 situated at Chettipatti Village, Aruppukottai Taluk and Virudhunagar District by considering my representations along with receipt dated 17.09.2025 & 24.11.2025. This Writ Petition has been filed seeking for a direction to the respondents 2 & 3 herein to survey and demarcate the land comprised in S.Nos.59/14, 59/19, 59/26, 59/28, 59/30, 59/31, 59/32, 59/36 and 59/44 situated at Chettipatti Village, Aruppukottai Taluk and Virudhunagar District by considering the petitioner's representations along with receipt dated 17.09.2025 & 24.11.2025. 2.With the consent of the parties, the Writ Petition is taken up for final disposal at the admission stage itself. 2/6
3.The petitioner's grievance is that though she has made applications for survey and demarcation of boundaries of the subject land on 17.09.2025 & 24.11.2025, however, the same have been kept pending till date. Hence, the present Writ Petition. 4.The learned Government Advocate appearing for the respondents would submit that the petitioner is not the owner of the subject property and it is apprehended that there are disputes regarding the subject property. Therefore, the rival claimants can only approach the civil court.
5.However, learned Counsel for the petitioner would submit that he would be satisfied if his representation is disposed of in accordance with law.
6.Recording the aforesaid submission, this Court directs the respondents 2 & 3 to consider the applications of the petitioner dated 17.09.2025 & 24.11.2025, on merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner as well as all other persons, who may be interested in the subject property, within a period of four [4] weeks from the date of 3/6
receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondent 2 & 3 to consider the same on its own merits.
7.With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
