PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to reopen and reissue the passport in petitioner's passport application No.TR1075567330825 dated 01.09.2025, by deleting the first husband name Abdullah and include the petitioner's second husband name Mohammed Sithick Rahman in the petitioner's passport within the time frame as fixed by this Court. ORDER
The present writ petition has been filed seeking a direction to the respondents to reopen and reissue the petitioner's passport based upon her application dated 01.09.2025 by deleting the first husband's name and include her second husband's name.
2. According to the learned counsel appearing for the writ petitioner, the petitioner had divorced her first husband by way of customary divorce under the Mohammedan Law and thereafter, got re-married. According to him, her first husband has also remarried.
3. The respondents official have called upon the writ petitioner to produce the Court records relating to the divorce of the writ petitioner. Since the petitioner could not produce the same, her passport application has been closed by the respondents officials. Hence, the present writ petition.
4. The facts narrated above will clearly establish that the petitioner as on today has not approached any competent Court to get her first marriage terminated. In such circumstances, the second respondent official cannot be directed to consider the request of the petitioner for deleting the name of the first husband and incorporate the name of the second husband. 2/4
5. In view of the above said facts, unless the petitioner produces the divorce order of the Court, the respondent officials cannot be directed to consider the request of the petitioner.
6. With the above said observations, this writ petition stands disposed of. No costs.
