ORDER

This Criminal Original Petition has been filed to direct the learned 3rd Additional District and Sessions Court (PCR) Cases, Madurai, to consider the bail application of the petitioner concerned in Crime No.17 of 2025 on the file of the Inspector of Police, AWPS Melur Police Station, Madurai District/1st Respondent herein.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3.The case of the prosecution is that the petitioner and the defacto complainant were in a relationship from 05.05.2020. On the promise of marriage, the petitioner and the defacto complainant lived together as 2/5

husband and wife. Thereafter, when the defacto complainant asked the petitioner to marry her, he refused the same with some excuse. Subsequently, the defacto complainant came to know that the petitioner was in a relationship with another woman. When she questioned the petitioner about the same, he allegedly abused her by saying her caste name. Based on these allegations, an FIR has been registered against the petitioner.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned 3rd Additional District and Sessions Court (PCR) Cases, Madurai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.17 of 2025 on the file of the 2nd respondent police.
